Acceptable Usage Policy & Terms of Service

Introduction

This agreement governs the use of all NamePack LLC's services, except as otherwise agreed in writing. Violation of this agreement may result in suspension or termination of your service. In the event of a dispute between you and NamePack LLC regarding the interpretation of this agreement, NamePack LLC's interpretation shall govern. If you have any questions regarding this agreement, contact our Support Department. Use of NamePack LLC's services constitutes acceptance of this agreement.

Prohibited Content & Activities

You may not host, publish, distribute, transfer or transmit any information via NamePack LLC's services that:

Is unfair or deceptive under consumer protection laws, including chain letters and pyramid schemes
Is defamatory or violates a person's privacy
Creates a risk to person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with law enforcement investigations
Improperly exposes trade secrets or confidential information
Is intended to assist others in defeating technical copyright protections
Infringes on trade marks, patents, or other property rights
Promotes illegal activities including but not limited to: illegal drugs, export control violations, illegal gambling, or arms trafficking
Is otherwise illegal or solicits illegal conduct
Is malicious, fraudulent, or may result in retaliation against NamePack LLC

Violation of any of these terms will result in a minimum fee of $50.00 and may lead to immediate service suspension or termination.

Security Requirements

You must take all necessary security precautions to ensure the security of your server and our network. NamePack LLC is not responsible for your server's security, and if we believe your server to be compromised, it may be disconnected without notice and possibly formatted. You must:

Maintain strong security measures for your server
Protect password confidentiality
Change passwords periodically
Report any security breaches immediately

Security violations will incur a minimum fee of $50.00 and may result in service suspension.

DDoS Protection

DDoS protection is available only on selected servers. The following terms apply:

DDoS protection is not included by default on all servers
Availability must be verified in individual server specifications
Additional fees may apply for DDoS protection services
Protection levels and capabilities vary by server type

Attempting to circumvent or abuse DDoS protection systems will result in immediate service termination.

Email Policies & Restrictions

Email Service Restrictions

IMPORTANT: All SMTP ports and email sending capabilities are blocked on our VPS services. You cannot send emails directly from our servers.

Due to security measures and anti-spam policies, we enforce a complete block on all SMTP ports and email sending capabilities. Customers requiring email functionality must:

Use third-party email service providers
Configure external SMTP services
Set up alternative email delivery methods

Email-Related Prohibitions

Attempting to bypass SMTP blocks - $350.00 minimum fee
Using unauthorized email relay services
Setting up unauthorized mail servers
Configuring spam-related services
Email harvesting or scraping activities

Any attempts to circumvent email restrictions will result in immediate service suspension and applicable penalties.

Recommended Alternatives

We recommend using established third-party email service providers for your email needs:

Transactional email services (SendGrid, Mailgun, etc.)
Business email providers (Google Workspace, Microsoft 365)
Marketing email platforms (Mailchimp, Campaign Monitor)

Copyright Protection

You may not publish, distribute, or copy any copyrighted material unless:

You have explicit authorization from the copyright owner
You are permitted by U.S. copyright law

DMCA Notices

DMCA notices must include:

Authorized representative's signature
Identification of copyrighted work
Description of infringing material
Contact information
Good faith statement
Authority to act statement under penalty of perjury

Internet Abuse

The following activities are strictly prohibited:

Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network
Unauthorized monitoring of data or traffic on any network or system
Service interference including mail bombing, flooding, deliberate attempts to overload a system, and broadcast attacks
Use of an Internet account or computer without authorization, including password robbery, security hole scanning, and port scanning
Forging of any TCP-IP packet header or any part of the header information
Actions likely to provoke retaliation against our network
Network usage that unreasonably interferes with other customers

Internet abuse violations incur a minimum fee of $100.00 plus possible service suspension.

Newsgroup & Chat Forums

You must comply with the rules and conventions for postings to any bulletin board, chat group, or other forum in which you participate, including IRC and USENET groups.

Important Restrictions:

IRC Networks are strictly prohibited on our network
Off-topic commercial messages are not allowed
Mass postings to multiple forums are prohibited

Violations incur a minimum fee of $100.00 and may result in service suspension.

Payment Policies

We accept payments through Stripe and cryptocurrency only. All payments are due by 5:00 PM EST on their renewal date. Late payments result in service suspension.

Fee Structure:

Payment disputes/chargebacks: $75.00 - $150.00 administrative fee
Service disconnection: $75.00 fee per server
Bandwidth overages: $0.50 per GB
All payments are non-refundable

Unpaid invoices may be sent to collections. You will be responsible for all collection, legal, and attorney costs.

Service Cancellation

Cancellations must be submitted through our Client Portal only. Other forms of cancellation requests will be ignored.

Cancellation requires confirmation from us
Must be submitted one (1) calendar day before next billing date
Late cancellations are invalid and will not be prorated
If no confirmation is received, you must submit in writing

Termination may result in administrative charges which you accept responsibility for.

Disclaimers & Warranties

Services are provided "as is," "with all faults," and "as available" without warranty of any kind. NamePack LLC:

Makes no warranty of services
Is not responsible for data backups
May restrict server access
Is not liable for data loss or corruption
Does not guarantee continuous service availability
Is not responsible for service interruptions or inaccuracies

Limitation of Liability

Under no circumstances shall NamePack LLC be liable for any damages arising from service use or interruption, including consequential, special, incidental, or indirect damages. Maximum liability shall not exceed the amount paid for services.

Legal Framework

Governing Law

This agreement shall be construed in accordance with applicable state laws.

Arbitration

Any disputes shall be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association. The parties will select a mutually acceptable arbitrator knowledgeable about issues relating to this agreement.

Arbitration location will be mutually agreed upon
All relevant documents must be shared within 30 days
Arbitrator(s) cannot modify contract provisions or award punitive damages
Decision is final and binding

Construction and Interpretation

The rule requiring construction or interpretation against the drafter is waived. The document shall be deemed as if drafted by both parties in a mutual effort.
